My name is Franklin and I was 19 soon to be twenty when my inlaws had a get together. There was drinking and weed smoking. Everything was chill. This very night changed my life for ever. I was approached and hit on by a young lady that I had know for a few years. Her mother dated my uncle who was a known addict who slept on the couches of various family members. On this night they left her with us. We were in the garage and she start kissing me on my neck and grabbing me. Even so when I drink malt liquor back then I could get a reaction. So we kissed, bumped and grinded but that was it. I did allow her to attempt to give me oral sex act but I just couldn’t get it up. So my cousin ended up having intercourse with her. Months went by and I was called by a detective who lied to me so as to get me to go with them to their station. They came out to another jurisdiction to deceive me into going with them. I answered all their questions and at the end of the interview was told if I didn’t hear any thing in 6 months I wouldn’t be charged. Well after six months I moved to Arkansas and attempted to get my life back on track. I was getting off work at midnight and I went to a friend’s apartment where two men were fighting and one of them started stabbing himself in the neck and chest. So I called police and waited for their arrival. Once the police took my statement, they ran my driver’s license and arrested me! THATS WHEN I WAS INFORMED THAT I HAD BEEN INDICTED. Texas decided to move forward and I was extradited back there. Before extradition I was given my charges …They read as aggravated sexual assault of a child which carries 5 to 99. Once I reached the county I was arraigned and sent to the jail. My bond was set at $100,000. So needless to say, I could not bond out. On my second appearance, my lawyer informed me that the DNA results came back and neither I nor my cousin were a match. The insane part is she was pregnant and her mother couldn’t afford an abortion, but she knew that under certain circumstances like rape or incest the abortion would be free. I sat 18 months in county jail and on my final court date before I took a two year plea with time served ..and I was sent to prison for 8 months in Texas.
I was not a violent person. I’ve made mistakes as a young man and was thrown into the abyss of the Texas penal system. With this kind of charge, I was constantly fighting to defend my self and my manhood. By the time my eight months was served I was sent to Barry Telford – a maximum security prison – for fighting. All I can say is prison only makes you worse. I was serving an 8-month sentence that placed me with killers, rapists, people with multiple life sentences. How did this happen?!? The young lady turned out to be a year younger than she told me and in Texas, the age of consent is 17 and the legal age gap was 3 years …I pleaded no contest to second degree sexual assault which carries 2 to 20. Big difference than 5 to 99! With no physical evidence of violence and the DNA was not mine. Two years with most of my time served in county plus life time registry.
Present day – I’ve rented from a landlord for 9 years, I’ve always paid my rent on time, kept my yard mowed and performed my own repairs. Both my children were born here. I have a 6-year-old daughter and a 7-year-old son and almost every year since their birth we’ve been harassed and my children have been bullied at home and at school. I was threatened – even slandered – to the point where we had no more piece of mind yet we kept paying our rent. Then earlier last month we were served an eviction notice to vacate for failure to pay rent! It was completely illegal. After all, I have bank statements and receipts to prove that I had always paid on time. We knew our rights and could have protested it but that meant months of court and money we don’t have. BESIDES WE WANTED OUT OF THERE, so we stayed until the next time our rent was due and we left that morning. Days before, we rented a U-haul and placed our life in storage. We are now in another city trying to find a home.
